DFD's legal counsel, who specializes in fire service law, has advised us that, for properties with assessed taxes for the DeFreestville Fire Protection District -- a separate district from NGFD #1 -- the Comptroller's opinion may not apply at all. The Fire Protection District includes significant areas of the proposed Village, such as the intersection at Routes 4 & 43, the Dutch Acres neighborhood, and areas along Bloomingrove Drive south of Teliska Avenue. Our legal counsel has advised that, according to NYS Village Law and two other State Comptroller's opinions, an incorporated fire department, such as DFD, that is located within a newly incorporated village becomes a village fire department and falls under the authority of the Village
